Q: Do I need to belong to a DOT random consortium if I am an owner/operator?
Yes, if your vehicle is 26,001 weight or greater, you carry hazardous materials or transport 16 or more passengers, then you are required to be in a DOT Random Testing program and have an annual query in the FMCSA Drug & Alcohol Clearinghouse.

Q: A driver was taken off the random by mistake. He went from full time to part time. I changed his status back to active. Do I need to do anything else?
That was the correct thing to do, if it's been more than 30 days since he/she has been in the random pool, another pre-hire test is required as well. A best practice is to review your random pool regularly and in particular, before the next selection period. Make sure as you hire new workers, you "hire" them in our portal to be added to your random pool. It's easy to update, remove or add workers to your pool on our DFB on-line portal. If you need help, it's only a phone call or email away!

Q: What is the FMCSA Drug and Alcohol Clearinghouse?
The FMCSA Clearinghouse is a national database to provide employers a place to check on the drug and alcohol background of potential drivers before they hire them for their company. Employers who hire DOT drivers and who fall under Federal Motor Carrier regulations are required to query this Clearinghouse before hiring a DOT driver and to do an annual query on their existing drivers. If they fail to do this, they can be fined.

Q: Can I test my employees for cannabis?
In most cases, the answer is yes. If your employees are under Federal Department of Transportation (DOT) regulations, then you must include marijuana in your test panel. If your employees are not under DOT regulations (NON-DOT) the answer is likely to be yes, but it also will depends on the state(s) where your employees are located and what kind of work they do. Each state is different and may have their own rules about testing for cannabis. In some states, there are no rules restricting testing and in others, like WA and CA for example, have new state laws that limit how and who you can test for Cannabis. The most important thing, is to work with a provider, like DFB who knows the rules in all 50 states and can help you with your drug testing program to keep your employees safe on the job.
